Terms of Use

This is an UNOFFICIAL translation from the french. Please, refer to the french original text for exact meaning.

I. General Terms and Conditions of Use

I.1. General Information

In this document indifferently referred to as “the Contract” or “Rules” :

This Agreement between you, as user and / or visitor on the Site and in the Virtual World, and us, is ruled by French laws. Any dispute arising either from the use of the Site or the Virtual World, or from this Agreement will fall within the exclusive jurisdiction of the courts of Tarbes, in France.

You are entitled by the Virtus association, to access the Virtual World and use the Website provided you comply with all the terms of the Contract, without any restriction. This Agreement may be amended at any time with or without prior notice (refer to section I.6. “Amendments of this Agreement”).

Nobody may be considered forfeited to our rights that are under this Agreement because of delay in exercising them, or even not exercising them.

Would any competent Court consider one or several items of this contract as void or invalid, these items should be considered as unwritten, the remaining items of the Contract will retain their validity and strength.

Unless otherwise stated, all prices are quoted and only payable in Euros.

YOU AKNOWLEDGE THAT YOU HAVE FULLY READ, UNDERSTOOD AND AGREED TO THIS WHOLE PRESENT DOCUMENT / AGREEMENT BEFORE USING THE SITE OR LOGGING INTO THE VIRTUAL WORLD.

I.2. Use of the Virtual World

I.2.a. Registration

To use the Service, you must both create an account and :

In case of incorrect information, we reserve the right to stop or even delete the account within one (1) week from the date of notification by email (refer to Article I.8. Suspension and termination).

You state that you have full power and full ability to enter into and fulfil all the provisions of this Agreement.

I.2.b. Minors

Parents, guardians, or organizations in charge of children thirteen (13) years old or older wishing to allow children under their responsibility to use the Service must first make a request by mail to the Virtus association at this address :

Your request will be examined by the administrators who keep the right to ask for any useful proof of identity of children under 18, as well as guardians. The administrators reserve the right to refuse any application at their sole discretion.

ANY CHILD UNDER 18 MUST BE ACCOMPANIED DURING ITS USE OF THE SERVICE BY A PERSON LEGALLY IN CHARGE OF IT. THE MINOR IS UNDER THE FULL LIABILITY OF LEGAL PERSON IN CHARGE WHICH BE HELD SOLELY RESPONSIBLE FOR ITS SECURITY. VIRTUS DISCLAIMS ANY RESPONSIBILITY FOR BOTH THE USE OF THE SERVICE BY THE MINOR, AND AS TO THE CONTENT DISPLAYED, VIRTUS BEING ONLY INVOLVED AS SERVICE AND HOSTING PROVIDER.

I.2.c. Privacy and Security Account

You are responsible for your Account, and you must make sure to preserve its confidentiality. You assume the safekeeping of your login (user name and password) and the risks of loss or theft. So take any step to ensure full security of your account and your personal data. Never disclose your personal data, passwords and any other key data to anyone, not even an administrator or a person claiming to be an administrator.

You must immediately notify the administrators in case of having lost, forgotten your login, unauthorized access to your personal data or passwords, or misuse of an Account user via the support platform to the http://www.newworldgrid.com/support address.

We may ask you to change your user name if it does not meet the Community standards, laws, or for any other reason at our sole discretion.

You agree to create Account only in your own name and only for your personal use. Through the use of the NWG-API designated service (New World Grid Application Programming Interface) located at http://api.newworldgrid.com, special conditions may apply.

You agree not impersonating another person or user or misleading any user.

I.2.d. Service Access

You need the get the suitable equipment and technology to access the Service. The required software for connecting to the Service are only supplied.

You should also make sure that your hardware, your operating system, your computer hardware and software setup, and your Internet subscription are compatible and powerful enough to access the Service.

We can not be required to afford any kind of expense of any kind, spent for accessing, or holding the access to the Service.

I.2.e. Service use

You agree to use the Service only under this Agreement, in accordance with laws and Community Standards in force.

You are solely responsible for the integration and distribution of information and data whatever type they are, photos, text, sounds, and any other types of data.

YOU AGREE TO BE RESPONSIBLE FOR THE CONSEQUENCES OF THE INTRODUCTION OF CONTENT ON THE SITE AND IN THE VIRTUAL WORLD WITHOUT ANY RESTRICTION.

You agree not to use the Service for pyramid schemes sales, sending chains of unsolicited messages or spam, advertisements or promotions.

You agree not to upload to or from the Service, display or distribute any Content that infringes or exhort to undermine morality, laws, the Community Standards, or any other regulation.

You agree not to infringe the rights of any person, group or organization, infringe a duty of confidentiality, and not commit our responsibility to any person, group or organization.

You agree not to advertise or promote the sale or purchase without any approval of the directors, and with commercial purposes on the virtual public spaces.

You agree not to restrict or prevent the use of the Service, not to try to disrupt its proper running.

You agree not to copy data of an Account whatsoever it is and not to disclose them to third parties. This also concerns, without limitation, IP addresses or user domain names or Service servers, whether private, public, belonging to a user or to Virtus. You may not use such data under any circumstances, in particular for user identification.

You agree to notify us any content not complying with the law or these rules via the support platform at http://www.newworldgrid.com/support.

I.2.f. Content

As a Service provider and web host, we do not validate the downloaded Content to or from the Service. As such, we do not validate the Content and the data transiting through the Service. We disclaim any responsibility for the consequences from the use of such Content. You agree to take full responsibility for the Content that you download to or from the Service.

I.2.g. Security

You agree not to attempt to access our servers, systems of information or to our database without authorization.

You agree not to download to the Service any data, programming routine or altered content, including viruses, worms, Trojan horses, logic bombs, or harmful programs to people and goods.

You agree not to interfere in the communication protocol between the servers and computers connected to the Service, and not to alter or conceal any data element, including headers, identifiers or IP addresses.

You agree to only use the software downloadable or recommended on the site to log in and use the Service, unless authorized by the administrators or in case of special conditions.

I.2.h. Software

Except the Software which you can legally get the sources, for instance software under open source license such as GNU General Public License “or” BSD “, all the rights related to some software downloadable from the Site, including the Software designated by New World Studio, are reserved.

You agree not to decompile, not to practise reverse engineering steps, or not to study protocol communication software available for download on the Site and which are not under open source license, and not the sublicense them.

WE GIVE NO WARRANTY AS TO THE USE OF SOFTWARE DOWNLOADED FROM OUR SERVICE OR OTHER SOFTWARE USED TO ACCESS THE SERVICE.

I.2.i. Intellectual property and permissions

You agree not to upload to or from the Service Content for which you do not have exploitation and use rights. You also agree not to upload to or from the Service any Content when you know or believe that any content is not, or could not be legitimately or legally available to users.

We reserve the right to remove or amend any Content that is unlawful, infringing intellectual property, or not complying with the rules of this Agreement, or for any other reason at our sole discretion.

You grant some rights of use to the Association Virtus and users concerning the Content that you upload to the Service, in particular the rights of retaining them on our servers, including after your termination. Indeed, it is possible to copy, modify and distribute Contents to other users. Therefore there is a succinct system of permissions implemented in the Client software which you download for connecting to the Virtual World. These permissions are usually designated by “Copy” or “Modify” and “Resell / Give Away / Transfer” or “Forward”. By checking the appropriate permissions in the Client interface, you allow users to whom you distribute the Content or associated item to use, modify, distribute Content according to the permissions you have assigned. All these permissions are valid on the whole Virtual World. It is not expressly authorized to export any Content, even when all permissions “Copy”, “Edit” and “Forward” are assigned, unless you explicitly specify by all means that the user is allowed to export the Content and use it outside the Virtual World. These permissions apply contract between users. We encourage you to contact us via the platform support at http://www.newworldgrid.com/support for more information on these permission systems.

Although the various software available for download from the Site may have functionality for Content backup, for purely practical purposes, it is to users to check that they have full rights of Content exploitation and use before copying or saving it.

If you believe that some Content violates your rights, we urge you to contact us immediately via the platform support at http://www.newworldgrid.com/support to let us know. We disclaim any responsibility for users their Content use.

Without permission or consent of the directors, you may not use the names of Virtus or New World Grid and their associated logos.

I.2.j. Using Hypergrid

Hypergrid is a developing technology that allows the Service users to access in virtual worlds located on the OpenSimulator software platform but neither belonging to the Virtus Association nor to New World Grid. This technology is considered unstable and under “Alpha” development same as it is for OpenSimulator (see under I.7.a. stability, run potentiality, performance). Hypergrid will be gradually activated or deactivated on the various virtual spaces of New World Grid and taking account of criteria such as a minimum of stability and security at the discretion of Technical Managers.

Hypergrid can be used by the Service users for teleporting from New World Grid toward an external virtual world, and conversely. Similarly, users of virtual worlds external services can teleport to New World Grid, and conversely.

Any user coming from any other virtual world than New World Grid is automatically notified that he or she is entering on New World Grid and he or she receives a notification with a link to these Terms of Use. By logging on the New World Grid he or she commits to FULLY read, accept, and comply with the rating of content into force.

It is also possible for users of these different services to exchange or not inventory items, Content. ANY CONTENT OF NEW WORLD GRID CANNOT BE USED OR EXPORTED ON OTHER VIRTUAL WORLDS, EVEN IF THIS CONTENT IS PROVIDED WITH ALL PERMISSIONS (Copy, Modification and Transfer), WITH THE EXCEPTION OF CONTENT CREATED BY THE USER HIMSELF / HERSELF OR OF CONTENT WITH AN AUTHORIZATION TO IMPORT IT TO OTHER SERVICES / VIRTUAL WORLDS, EXPLICIT AND IN A COMPREHENSIVE MANNER (BY INCLUDING THE RELEVANT LICENSE). IN ACCORDANCE WITH THE SCOPE OF THE VIRTUS ASSOCIATION PHILOSOPHY, WE ARE STRONGLY ENCOURAGING WITHOUT OBLIGATION, ANY SERVICE USER TO PROPOSE AN OPEN SOURCE CONTENT AND / OR FREE WHICH CAN BE USED FOR FREE ON ALL VIRTUAL WORLDS BASED ON OPENSIMULATOR. FOR THIS PURPOSE, THE SERVICE USERS CAN INCLUDE A NOTE OR “NOTECARD” WHOSE TEXT IS THE USING LICENSE APPLYING TO THE CONTENT. IN ABSENCE OF AN EXPLICIT LICENSE, THE SERVICE USER MUST ASK FOR AN AUTHORIZATION TO THE PROPER CONTENT CREATOR, AND KEEP IN MIND THAT THE CONTENT IS NOT AUTHORIZED FOR EXPORT TO EXTERNAL VIRTUAL WORLDS.

THE SAME WAY, ANY USER COMING FROM AN EXTERNAL VIRTUAL WORLD IS COMMITTED TO RESPECT THE CONDITIONS OF USE OF THE VIRTUAL WORLD ON WHICH HE OR SHE HAS REGISTERED, AND IS COMMITTED NOT TO IMPORT AND NOT TO USE ANY CONTENT ON NEW WORLD GRID WITHOUT AUTHORIZATION OF THE PROPER CREATOR, AND WITHOUT AUTHORIZATION IF THE CONTENT IS LICENSED.

ANY REGISTERED USER ON NEW WORLD GRID OR COMING FROM AN EXTERNAL VIRTUAL WORLD ALSO AGREES NOT BRINGING CONTENT NOT COMPLYING WITH THE CONTENT CLASSIFICATION IN FORCE ON NEW WORLD GRID AND NOT INSTALLING OR PROVIDING ANY TELEPORT LINK ENABLING NEW WORLD GRID USER OR USER IN AN EXTERNALVIRTUAL WORLD TO ACCESS TO CONTENT NOT COMPLYING WITH CLASSIFICATION AS HEREABOVE.

THE VIRTUS ASSOCIATION AND ITS MANAGERS ENDEAVOR TO ENCOURAGE A FREE CONTENT, AND SERVICE USERS ARE REGULARLY INFORMED ON THE TOPIC OF INTELLECTUAL PROPERTY. HOWEVER, THE ASSOCIATION AND ITS MEMBERS DISCLAIMS ANY LIABILITY WITH REGARD TO THE NON RESPECT OF THE INTELLECTUAL PROPERTY BY SERVICE USERS.

AT LAST, THE WHOLE CURRENT TERMS OF USE APPLIES TO EXTERNAL VIRTUAL WORLD USERS WITHOUT RESTRICTION.

I.3. Technical and storage limitations

We reserve the right to establish the rules for technical limitations and storage related to the use of the Service.

The Content present on our servers may be subject to a maximum of conservation duration.

We keep the right to delete not working accounts and their Content, commonly named as “Inventory”, possibly combined with these account for more than one (1) year.

We reserve the right to remove any Content that has not been accessed for more than one (1) year, this for administrative and servicing purpose required by servers and data storage capacity. It is up to users to operate their Content and make backups of useful items for which they have rights in the broadest sense of the term.

We keep the right to limit the amount of virtual space also known as “field”, “region”, “simulator” or “sim”, particularly related, but not limited to the New World Studio software.

I.4. Paid Services

We determine the amount and means of payment of paid services which can be modified over time based on changes in prices of our service providers or the evolution of our finances.

Some paid services can be permanently or temporarily deleted depending on the availability of our resources and those of our suppliers. Paid services which you have purchased may also vary provided that they evolve in a neutral or positive way for you (see also section I.5. “Modifications of the Service”).

Unless explicitly stated or special conditions, paid services are not downloadable, and will remain on our servers.

Any Service fee is payable in advance, at least one (1) week before the Service will be delivered. These services involving providers or partners paid in advance for a predetermined time, you can not claim any refund of expenses incurred directly or indirectly in the event of termination. Nevertheless you keep all but the enjoyment of these services until the end of the period for which you have paid (refer to Article I.8. “Termination and Suspension”).

I.5. Service Changes

We reserve the right to limit, modify, delete or discontinue, temporarily or permanently, any feature, operation of the Site, of the Virtual World, and more generally of the Service.

We reserve the right to limit, modify, delete or block, either temporarily or permanently, any access means to the Service, including changing the list of software allowed to connect to the Service, or blocking some software.

Should any major change or interruption occur, you would be notified in advance by email, provided that the email address is functional and exist and that you regularly consult your email box. These major changes will be announced on the blog site at http://www.newworldgrid.com/blog.

You will be able to terminate the Contract in accordance with Articles I.2.d. “Access Service” and I.8. “Termination and suspension”.

I.6. Amendments to this Agreement

We reserve the right to amend various arrangements of this Agreement. Your use of the Site, the Virtual World, and more generally of the Service after the implementation of these modifications are worth accepting the new Contract.

You agree to keep you regularly informed (e) through the blog at the address http://www.newworldgrid.com/blog or by contacting an administrator or the platform support http://www.newworldgrid. com/support.

I.7. Limitations of warranties and liability

I.7.a. Stability, operability, performance

The Virtual World is based on a software platform named OpenSimulator (http://opensimulator.org) and should be considered experimental in the broadest sense of the term. The platform is under active development but shall in no circumstances be considered as stable, secure. As such, and although we endeavour our best to provide a stable and efficient environment , Virtus presents no guarantee of stability, operability, and disclaims any responsibility.

On the other hand, Virtus is a non-profit Association that operates through volunteering and donations from its members and users and Services incomes.

WE DO NOT WARRANT IN ANY EVENT THAT THE SITE, THE VIRTUAL WORLD, AND MORE GENERALLY THE SERVICE WILL BE AVAILABLE PERMANENTLY AND FREE OF ANY ERROR OR VIRUS-FREE, STABLE OR TOP EFFICIENT WE ASSUME NO LIABILITY FOR LOSS OF DATA, DAMAGE OR DESTRUCTION OF EQUIPMENT OR SYSTEMS, INTERRUPTION OF SERVICES AND OTHER PROBLEMS OF OPERATION.

WE DO NOT WARRANT THE ACCURACY, COMPLETENESS AND UPDATING OF THE INFORMATION HEREIN ON THE SITE AND IN THE VIRTUAL WORLD.

I.7.b. Content Security

WE CAN NOT BE LIABLE FOR ANY USE OF CONTENTS WITHOUT AUTHORIZATION, BYPASS OF PERMISSION SYSTEM OR ANY OTHER EXISTING PROTECTION SYSTEM. USERS ARE SOLELY RESPONSIBLE FOR THEIR ACTS AND THE USE MADE OF CONTENTS.

SIMILARLY, ALTHOUGH THE COPY AND RESTORATION SYSTEMS INCLUDING THE SOFTWARE KNOWN AS “COPYBOT” OR OTHER “BOTS” CAN CONNECT, WE CAN NOT BE CONSIDERED AS RESPONSIBLE FOR THEIR MISUSE.

FINALLY, WE ARE NOT BE HELD RESPONSIBLE IN CASE OF NON-COMPLIANCE OF THE INTELLECTUAL PROPERTY BY THIRD PARTIES AND USERS AND YOU AGREE TO ASSUME ANY COMPENSATION OR PAYMENT OF ANY PERSON, GROUP, ORGANIZATION OR THIRD PARTIES (INCLUDING THE BODIES OF RIGHTS, COPYRIGHT AND INTELLECTUAL PROPERTY MANAGEMENT).

TAKING INTO ACCOUNT THE STATE OF EXPERIMENTAL PROJECT ANDOF THE PLATFORM, VIRTUS CAN NOT BE HELD RESPONSIBLE FOR THE SECURITY OF YOUR DATA. WITH THE EXCEPTION OF PROVISIONS OF OUR PRIVACY POLICY, WE MAKE NO WARRANTY CONCERNING YOUR ACTIVITIES AND THE SECURITY AND INTEGRITY OF DATA IN CASE THEY MAY BE DISCLOSED.

I.7.c. Limitation of Liability

IN THE LEGAL FIELD, WE DISCLAIM ANY LIABILITY TO YOU, OR AS TO ANY LOSS OR DIRECT OR INDIRECT DAMAGES WHATSOEVER, OR TERMINATION OF BUSINESS BECAUSE OF YOUR USE OF THE SITE OR THE VIRTUAL WORLD, OR MORE GENERALLY OF THE SERVICE, AND WHATEVER THE NATURE REAL OR PERCIEVED OF LIABILITY, LOSSES OR DAMAGES.

IF OUR LIABILITY SHALL BE LIABLE UNDER THIS AGREEMENT AND AT THE EXCLUSION OF CONTINGENCIES OF THE PRECEDING PARAGRAPH, YOU CAN NOT EXPECT A COMPENSATION FOR ANY AMOUNT EXCEEDING THE AMOUNT OF SERVICES PAID DURING THE THREE (3) MONTHS MAXIMUM BEFORE THE EVENT WHICH CAUSED THE LOSSES OR DAMAGES WHATSOEVER.

I.7.d. Compensation

You agree to compensate us or to compensate copyright holders for any loss or damage, financial, and defence costs incurred in connection with this Contract.

I.7.e. Using currency exchange system

Any monetary system, exchange of real money are now prohibited in the Virtual World.

THE OPENSIMSULATOR PLATFORM IS DEEMED UNSTABLE AND NOT SECURE, VIRTUS CAN NOT BE HELD RESPONSIBLE FOR THE USE OF ANY SYSTEM ENABLING DIRECTLY OR INDIRECTLY THE EXCHANGE OF MONEY OR THE SALE OR PURCHASE OF ANY KIND OF PRODUCT.

I.8. Termination and suspension

I.8.a. Conditions of termination

You may terminate this Agreement at any time and for any reason by contacting us through the platform support http://www.newworldgrid.com/support.

The termination does not involve repayment of sums paid, or compensation whatsoever. You keep the enjoyment of Paying Services contracted through to completion if you wish, unless special conditions or if the termination is performed by administrative decision for non-compliance with this Agreement.

I.8.b. Consequences of termination

We reserve the right to keep the Content that you have inserted, modified and more generally the Content with which you interact in any way whatsoever, with the exception of your Personal Data, as defined in the Privacy Policy, which can be withdrawn on demand (see also section I.2.i. “Intellectual Property and permissions”). As such, you can not claim any remuneration, compensation or damages for whatever reason.

I.8.c. Termination

The termination of an account is a temporary interruption in access to the Service. Although a suspension may be imposed by administrators against a specific user account, such suspension may be extended at our sole discretion, to all accounts belonging to the person or entity who created the Account originally suspended.

The terms and conditions of termination imposed by the administrators, the duration of suspension specified in this Agreement, including Section III. “Community standards” are generally followed, although purely indicative.

II. Special Conditions

II.1. Gift of free/unrestricted Content

Any user has the right to offer his own creations to the New World Community Grid. Of course it must have all the permissions for the sharing and distribution of all types of components it makes available to other users (refer to section I.2.i. “Intellectual Property and permissions”).

These free items which have been donated by users are more commonly called “Freebies”. A space is available for each user that has these “Freebies” in free service and who is responsible for the Content and enforcement of intellectual property related to this Content.

II.2. Volunteer Program

Any user of the Virtual World has the right to enter the volunteer program by completing the form located on the site at http://www.newworldgrid.com/volunteers.

By joining this program, it will:

Any volunteer can freely leave the program at any time by notifying the administrators by email.

The voluntary status will be regularly reconsidered by the directors in case of absence or may be withdrawn for abuse, upon notification by email from the administrators.

II.3. Community Spaces

Community Areas are areas or parcels, or more generally spaces of virtual land owned by New World Grid, which are made available to users or organizations in order to develop a project. They are attributed by administrators only after review and approval of the submitted project.

The user which will get in charge one of these areas will therefore be considered as responsible for the evolution of its project, base of the area attribution by the Community. It commits to participate actively to its project implementation and agrees that the Community area having been allocated can be claimed back if the directors consider that the space is used inappropriately or that its use is inadequate and penalizes the implementation of projects being eligible for this Community area.

The Content on these Community Spaces is under responsibility of the project manager, and can be hold by us, unless specific condition or agreement.

II.4. Free Land

We provide you with the software “New World Studio” Which one you are allowed to download from the Site in order to accommodate the virtual field for free on your own computer or server. Its downloading or procurement by any other means is at your own risk, and in this regard, you are solely responsible for all damage caused to your computer system and data loss you may incur. The software contains confidential and copyrighted intellectual property.

We give no warranty concerning the Software “New World Studio.

Also, we can not be held liable in case of incompatibility of your router, result problem (related to a bad connection or a lack of bandwidth).

These virtual land (or “regions”) are restricted to free personal use and not commercial, it is not allowed to sublet land using the software “New World Studio.

The Content must conform to the current classification (refer to section III.2. “Content Rating”).

We reserve the right to limit or block the use of New World Studio software if these rules are not observed.

II.5. Land fee

You can rent virtual land as “plot” or “region” through us. Payments are made exclusively by using the PayPal payment buttons available on the Site.

In renting the regions through us, you contribute actively to the development of New World Grid but you also get a service of quality. You also receive the title of “Contributor” on your user profile in the Virtual World in recognition of your active participation in the operation of the Virtual World.

The updates and maintenance are included in the rent of your land on our virtual servers. Moreover you get some offers not available natively on the free areas (the voice conferencing feature, for example).

The subletting of plots is under investigation but has not yet been approved, and in that sense, you agree to a non-commercial use of your land.

You can at any time interrupt this lease by cancelling your PayPal subscription. However you enjoy your virtual field until the end of the paid period.

The servers being paid in advance with our service provider, no refund can be made.

The Content must conform to the current classification (refer to section III.2. “Content Rating”).

The breach of these rules may lead to termination of the lease.

III. Community Standards

Community Standards govern behaviour and relationships of users of the Virtual World and the site between them.

III.1. Behaviour

III.1.a. Intolerance

Intolerance includes any action that harms a person, group or any organization or which tends to limit free expression, exchange and creativity in the Virtual World, or that interferes with the Community in general and may be punished by a suspension of two (2) month minimum, or even termination.

More specifically, the inappropriate use of images, or more generally Content with reference to ethnicity, religion, sex, sexual orientation, abusive, defamatory, racist, homophobic, revisionist language use, and any allegation or imputation of an act that violates the honor or the consideration of a person, group or organization is proscribed in the Virtual World and may be the prosecuted.

Also outlawed incitement to hatred, violence, suicide, violation of laws or regulations whatsoever, and the glorification of war crimes or crimes against humanity.

III.1.b. Harassment

Harassment includes to behave aggressively and repeatedly or sustained, intimidating, threatening or affecting the sense of safety or mental health of any user, and may be punishable by a suspension of two (2) months minimum or even termination.

III.1.c. Assaults

Assault includes the act of pushing a person (his avatar), the rush to draw on it or using scripted objects taking a user as the target or disordering his freedom to use the Service normally, and can be sanctioned by a warning, suspension or termination if the assault is described as repetitive.

III.1.d. Disclosure

Every user is entitled to its privacy and personal space. The partition or retrieval of unauthorized personal data of a user whichever they are is banned. Similarly, users are not permitted to remotely monitor conversations or use the history of private or public conversations without the consent of everybody involved. In the case of abuse with these Rules, the user may send a copy of the conversations for evidence so that the administrators reserve the right to communicate in some cases to the police or competent authorities.

The invasion of an user privacy can be penalized by a suspension of at least two (2) months, even a termination when the infringement is considered significant.

III.1.e. Indecency

Although the Virtual World is not totally open to minors who are accepted by approval of administrators and under the supervision of an adult guardian, content and acts of each shall comply with the classification of Content in force (refer to Article III.2. “Content Rating”).

III.1.f. Disturbing the peace

Are regarded as disturbing the peace actions disturbing scheduled events, repeated and undesirable emission, or the use of scripts, programs, or any other way disrupting the Service operation and may be punished by a warning or a suspension, or termination in the event of a breach of the Service operation.

III.2. Content Rating

All areas of New World Grid, including the Site and the Virtual World, adhere to the same rules and are subject to the classification “Not recommended for children under twelve (12) years”.

Are classified as “Not recommended for under 12 years’ service whose contents involve representations or descriptions of sexual scenes, violence, physical or psychological, or likely to incite minors to commit dangerous acts or disapproved by society. Services whose contents are systematically use of foul language are also classified as “Not recommended for under 12”.

III.3. Dispute Resolution

A dispute occurs when a user files a complaint with us against a user, group or organization.

The user must contact the administrators via the platform support at http://www.newworldgrid.com/support, specifying eventually involved user names and all useful evidence relevant to the resolution of the dispute: chat, email, images, sounds, various references such as identifying data or “UUID” …

After receiving the complaint, administrators will contact the user or group in question to find a solution to the dispute.

In conclusion, any complaint can be reached by a simple warning to both parties. In the case of repeated warnings or conclusive evidence, suspension or termination may be imposed.

III.4. Moderators

A group of moderators has been created in order to assist the Administrators in the function of moderating content and users. Moderators may, in the absence of Administrators react in line to repeated non-compliance of these present Community Standards by any User of the virtual world and eventually dismiss any User, or temporary ban him/her on the public areas of New World Grid, in particular under the following cases:

  • true repeated insults or threats to the moral (psychological) or physical integrity of any user ;
  • indecency and breach of the content classification ‘Not recommended for under 12 ;
  • physical aggression in the virtual world (repeated jostling and excessive attacks with objects) ;
  • actions in order to explicitly affect the service (lag / deliberate slowdown, etc …) or to cause significant and lasting disruption to our experience of the virtual world ;

Any intervention of a Moderator is the object of a report to the Administrators which will be studied, and of a definitive decision.

IV. Privacy Policy

IV.1. General

The Privacy Policy is the set of rules and commitments that we make regarding your Personal Data.

Are regarded as Personal Data the data that identifies you actually directly or indirectly, that is to say :

IP address assigned to your computer or router or any other hardware with which you connect to the Service. An IP address is a serie of four numbers assigned by your ISP Internet which allow multiple computers Service to identify and communicate;

When you register for the Service, you may be asked to provide some Personal Data, so mandatory or optional.

When you connect to the site, a cookie may be created by the Site to facilitate your browsing. A cookie is a file containing information about your browsing the site. It is possible to reject the creation of cookies by setting your browser.

We are committed to protecting your Personal Data and not to disclose to third parties, except as provided by this Agreement or specific conditions.

WE ASSUME NO RESPONSIBILITY FOR THE USE OF LINKS REFERRING TO THIRD PARTY SITES PRESENT ON THE SITE OR THE VIRTUAL WORLD. OUR PRIVACY POLICY APPLIES ONLY TO OUR WEBSITE AND VIRTUAL WORLD.

IN THE CONTEXT OF THE ADMINISTRATIVE MANAGEMENT OF OUR OBLIGATIONS, YOU AGREE THAT ACCORDING THIS AGREEMENT WE KEEP YOUR IP CONNECTION ADDRESS BEYOND THE DURATION OF THE VALIDITY OF THIS AGREEMENT. YOU CAN NOT CLAIM THE REMOVAL OF IP ADDRESSES AND USER NAME OF YOUR ACCOUNT FROM OUR RECORDS DURING THE EXECUTION OF THIS CONTRACT AND AFTER ITS POSSIBLE TERMINATION.

IV.5. Minors

Minor users are not allowed to disclose their personal information in any area of the Virtual World or the Site, except with the consent of their parents or guardians.
It is up to parents to warn against the possible dangers of the Internet and help them in the Virtual World and the Site throughout the whole duration of their connection.
